These Terms and Conditions govern your use of the Tourium platform. By accessing or using our services, you agree to be bound by these terms. Please read them carefully before creating an account or using any of our features.

Acceptance of Terms

By creating an account, accessing, or using Tourium (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these terms.

If you do not agree with any part of these terms, you must not use the Platform. Your continued use of the Platform following any changes to these terms constitutes acceptance of those changes.

Definitions

  • Platform - The Tourium web application, including all subdomains, APIs, and related services operated by Tourium.
  • Supplier - A tourism business (lodge, hotel, transfer company, activity provider, or similar) that lists properties, manages rates, and distributes contracts through the Platform.
  • Agent - A travel agency, tour operator, DMC, or similar business that discovers suppliers, receives rate contracts, and manages bookings through the Platform.
  • Tenant - An organisation (Supplier or Agent) that has registered on the Platform and has been provisioned with an isolated workspace accessible via a unique subdomain.
  • User - Any individual who creates an account on the Platform, whether as an organisation owner, team member, or invitee.
  • Subscription - A recurring payment plan (Free or Teams) that determines the features, usage limits, and capabilities available to a Tenant.

Account Registration & Security

You must provide accurate, complete, and current information when creating an account. You may register using email and password or through supported OAuth providers (such as Google). You are responsible for maintaining the confidentiality of your account credentials.

Each user account is personal and must not be shared. Organisation owners may invite team members, who will receive their own individual accounts. The number of team members permitted depends on your active subscription plan.

You must notify us immediately if you suspect unauthorised access to your account. Tourium is not liable for any loss arising from unauthorised use of your account where you have failed to safeguard your credentials.

Subscriptions & Billing

Tourium offers subscription plans including a Free plan and paid plans (such as Teams). Paid subscriptions are billed monthly through PayFast. By subscribing to a paid plan, you authorise Tourium to charge your payment method on a recurring basis until you cancel.

Each subscription plan includes specific usage limits for features such as AI chat tokens, e-signature requests, and team member seats. Usage counters reset at the beginning of each billing cycle. If you exceed your plan limits, certain features may become temporarily unavailable until the next billing cycle or until you purchase a top-up.

You may upgrade, downgrade, or cancel your subscription at any time through your organisation settings. Downgrades and cancellations take effect at the end of the current billing period. Tourium reserves the right to modify plan pricing and features with 30 days' notice.

Top-up packs (for additional AI chat tokens or e-signature requests) are one-time purchases that are credited to your account upon successful payment and do not expire at the end of a billing cycle.

Refund Policy

We want you to be satisfied with Tourium. This section outlines when and how refunds may be issued for subscription payments and one-time purchases.

Refund Eligibility

  • If you cancel your paid subscription within 14 days of upgrading from the Free plan and have not substantially used the Platform's paid features, you may request a full refund of that billing period's charge.
  • If you experience a material service disruption or outage caused by Tourium that lasts more than 72 consecutive hours, you may request a pro-rata credit for the affected period.
  • Duplicate charges or billing errors will be refunded in full upon verification.

Non-Refundable Items

  • Subscription fees for billing periods where paid features have been substantially used (documents uploaded, contracts sent, AI queries made, etc.).
  • Partial billing periods - we do not provide pro-rata refunds for mid-cycle cancellations.
  • Downgrade differences - if you downgrade from a higher plan, the remaining balance is not refunded but the higher plan remains active until the end of the current billing cycle.
  • Charges incurred through third-party services accessed via the Platform (e.g., PMS integrations that have their own billing).

Refund Process

To request a refund, contact us at [email protected] with your account email, the charge in question, and the reason for your request. We aim to review and respond to all refund requests within 5 business days. Approved refunds are processed back to the original payment method and may take 5–10 business days to appear on your statement.

Top-Up Purchases

One-time top-up purchases (AI chat token packs and e-signature request packs) are non-refundable once credited to your account, as these credits are available for immediate use. Unused top-up credits are not transferable between organisations.

Exceptions

Tourium reserves the right to make exceptions to this policy on a case-by-case basis. If your account has been suspended or terminated for violation of these Terms, no refund will be issued for any remaining subscription period.

Acceptable Use

You agree to use the Platform only for lawful business purposes related to tourism supply and distribution. You must not:

  • Upload, transmit, or distribute content that is unlawful, harmful, threatening, defamatory, or infringes on intellectual property rights.
  • Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or connected systems.
  • Use automated tools, bots, or scripts to scrape, crawl, or extract data from the Platform without express written permission.
  • Interfere with or disrupt the Platform's infrastructure, security mechanisms, or other users' access to the service.
  • Use the AI chat features (Touri) to generate content that is misleading, fraudulent, or intended to deceive travellers or business partners.

Intellectual Property

The Platform, including its design, code, branding, and AI models, is the intellectual property of Tourium. You are granted a limited, non-exclusive, non-transferable licence to use the Platform in accordance with your subscription and these terms.

You retain ownership of all content you upload to the Platform (documents, property descriptions, rate sheets, images, etc.). By uploading content, you grant Tourium a licence to process, store, index, and display that content as necessary to operate the Platform and provide our services, including AI-powered search and analysis features.

Data Processing

We process personal and business data as described in our Privacy Policy . By using the Platform, you consent to such processing.

Tourium operates a multi-tenant architecture where each organisation's data is stored in an isolated database schema. Your data is not shared with other tenants unless you explicitly initiate a connection, share a document, or send a contract to another organisation through the Platform's networking features.

AI Services & Touri Chat

Tourium provides AI-powered features including Touri Chat, document analysis, and intelligent search. These features use third-party AI providers (OpenAI and Anthropic) to process your queries and content. When you use AI features, relevant context from your organisation's documents and data may be sent to these providers for processing.

AI-generated content is provided for informational and productivity purposes only. Tourium does not guarantee the accuracy, completeness, or reliability of AI-generated responses. You are responsible for reviewing and verifying any AI-generated content before relying on it for business decisions.

AI chat usage is subject to your subscription plan's token limits. Token consumption varies by query complexity and response length.

Third-Party Services

The Platform integrates with various third-party services to provide its functionality. These include but are not limited to:

  • PayFast for payment processing and subscription management.
  • SignWell for electronic signature services on rate contracts and agreements.
  • PMS/CRS providers (such as NightsBridge, SabeeApp, ResRequest, and others) for property management and booking synchronisation.
  • Resend for transactional email delivery.

Your use of these third-party services through the Platform is subject to their respective terms and privacy policies. Tourium is not responsible for the availability, accuracy, or conduct of third-party services.

Limitation of Liability

To the maximum extent permitted by applicable law, Tourium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of or inability to use the Platform.

Tourium's total cumulative liability for all claims arising from or related to your use of the Platform shall not exceed the total fees paid by you to Tourium in the twelve (12) months preceding the event giving rise to the claim.

Termination

You may terminate your account at any time through your account settings or by contacting support. Upon termination, your access to the Platform will be revoked and your tenant workspace will be scheduled for deletion.

Tourium reserves the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if continued access poses a security risk to the Platform or other users.

Upon termination, we will retain your data for a reasonable period (typically 30 days) to allow for account recovery requests, after which your data will be permanently deleted. Data subject to legal retention requirements may be retained longer as required by law.

Changes to These Terms

Tourium reserves the right to update these Terms at any time. Material changes will be communicated via email to your registered address and/or through a notice on the Platform at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised terms.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.
